Resumen
El Estado cubano mantiene una firme voluntad política encaminada al desarrollo de la Propiedad Industrial. En la actualidad se reafirma el compromiso de situar en primer plano el papel de la ciencia, la tecnología y la innovación. Derivado de ello se evidencia la importancia de la Propiedad Intelectual y concretamente de la Propiedad Industrial. El presente trabajo se titula: Presupuestos Teórico- Jurídicos de la transmisión de los derechos de propiedad industrial en Cuba. Posee como objetivo general fundamentar los presupuestos teórico- jurídicos que deben sustentar la transmisión de los bienes inmateriales de Propiedad Industrial en Cuba para su adecuado tratamiento en las empresas, pues en la actualidad existen discrepancias en relación a la definición y naturaleza de los bienes inmateriales. Al no existir un criterio uniformado en torno a estas temáticas, se producen problemas e incongruencias para transmitir las creaciones derivadas de la Propiedad Industrial en las entidades, lo cual se une a la falta de experiencias que existen en la aplicación de las nuevas regulaciones existentes en esta materia. El Decreto ley 336/2018 es básico para la trasmisión de estos bienes en Cuba y consecuentemente para esta investigación, por ello se realiza un análisis exegético del mismo. Para ello el trabajo se dividió en dos capítulos: el primero titulado Los Bienes Inmateriales de Propiedad Intelectual. Valoración Teórico –Jurídica y un segundo capítulo titulado: La transmisión de los bienes de Propiedad Industrial en Cuba. Se arriba a diversas conclusiones que son resultado del cumplimiento de los objetivos propuestos.
The Cuban State maintains a firm political will aimed at the development of Industrial Property. At present, the commitment to place the role of science, technology and innovation in the foreground is reaffirmed. Derived from this, the importance of Intellectual Property and specifically of Industrial Property is evident. The present work is entitled: Theoretical-Legal Budgets of the transfer of industrial property rights in Cuba. Its general objective is to establish the theoretical-juridical assumptions that must support the transmission of the intangible assets of Industrial Property in Cuba for its adequate treatment in companies, since at present there are discrepancies in relation to the definition and nature of intangible assets. In the absence of a uniformed approach to these issues, there are problems and inconsistencies to transmit the creations derived from the Industrial Property in the entities, which joins the lack of experiences that exist in the application of the new existing regulations in this matter. Decree Law 336/2018 is basic for the transmission of these goods in Cuba and consequently for this investigation, for this reason an exegetical analysis of it is carried out. To this end, the work was divided into two chapters: the first entitled Intangible Assets of Intellectual Property. Theoretical-Legal Assessment and a second chapter entitled: The transmission of Industrial Property in Cuba. We arrive at several conclusions that are the result of the fulfillment of the proposed objectives.
