Resumen
La investigación se titula “El capital social de las cooperativas en Cuba. Fundamentos teóricos y jurídicos.” Posee como objetivo central: Delimitar cuáles son los fundamentos teórico-jurídicos del capital social cooperativo que deben influir en su regulación legal y estatutaria en Cuba.
Sobre la institución del capital social no se han realizado en Cuba los estudios
suficientes que permiten determinar los fundamentos teórico-jurídicos de la institución y no son regulados de forma expresa en las normas cooperativas
cubanas. El es tudio de esta institución es de suma importancia porque determina
los elementos que configuran el mismo y que deben ser regulados, dando respuesta la investigación al si guiente problema científico, ¿Cuáles son los
fundamentos teórico-jurídicos del capital social cooperativo en Cuba que deben
influir en su regulación legal y estatutaria?
En la investigación se hace una delimitación de los fundamentos teóricos-jurídicos
del capital social y se hace un análisis a nivel internacional y en Cuba, se identifica
la institución tanto en las normas reguladoras de cooperativas como en las normas
estatutarias de las mismas. Está dividido en dos capítulos: “Presupuestos teóricos –
jurídicos del capital social” y “El capital social de las cooperativas en Cuba.
Regulación jurídica”. Los resultados alcanzados son: Sistematización de los elementos teóricos-doctrinales y jurídicos del capital social que deben ser tenidos en cuenta para su regulación en Cuba y la obtención de bibliografía actualizada en
materia de capital social y cooperativas que puede ser utilizada en la enseñanza de
pregrado y postgrado, así como interesados en general en esta materia.
Valoración de las normas jurídicas cubanas en materia de cooperativismo con
tentiva de elementos que permiten perfeccionar la regulación del capital social en Cuba.
The investigation is titled "The social capital of the cooperatives in Cuba. Theoretical and juridical foundations. It possesses as central objective: To define which are the theoretical-juridical foundations of the cooperative social capital that should influence in their legal and statutory regulation in Cuba. On the institution of the social capital there have not been carried out in Cuba enough studies that allow us to determine the theoretical-juridical foundations of the institution and they are not regulated in an expressed way in the Cuban cooperative norms. The study of this institution is very important, because it determines the elements that configure the way that it should be regulated. The investigation answers to the following scientific problem. ¿Which are the theoretical-juridical foundations of the cooperative of social capital in Cuba that should influence in its legal and statutory regulation? In the investigation it is limiting the theoretical-juridical foundations of the cooperative of social capital and it is analyzing its characteristic in Cuba and in the international level, identifying the institution in their regulated norms and its statutory norms of the same ones. It is divided in two chapters: theoretical and juridical aspects of the social capital and the social capital of the cooperatives in Cuba. The results reached are: to systemise the theoretical elements - doctrinal and juridical of the social capital that should have in mind for their regulation in Cuba and the obtaining of up-to-date bibliography regarding social and cooperative capital that can be used in the pregrade teaching and graduate degree, as well as all people interested in this subject The optimizing of the Cuban juridical norms regarding cooperative containing the elements that allow to perfect the regulation of the social capital in Cuba.
