Resumen
La presente investigación tiene como tema: “La contaminación por ruido en el medio ambiente laboral. Consideraciones acerca de su regulación jurídica” y tiene como objetivo central demostrar las insuficiencias del marco legislativo e institucional para la regulación de la contaminación por ruido en el medio ambiente laboral en cuanto a su alcance y aplicación. La importancia del tema radica en el incesante aumento de los focos de ruido no controlados, en cuanto a un control efectivo y adecuado de su magnitud, localización y grado de afectación sobre la salud del trabajador y se reflejas su relevancia, dada su función condicionante ante la
aparición o empeoramiento de determinadas afecciones sobre la salud de los trabajadores expuestos; demostrándose que lo regulado no se cumple con efectividad.
Se alcanzaron como resultados un análisis teórico y sistemático del
Tema, logrando identificar las deficiencias del marco legislativo e institucional como precedente para futuras modificaciones legislativas, así como el desarrollo de la bibliografía para posteriores trabajos. Quedó estructurado en dos capítulos. El primero titulado “Generalidades acerca del ruido como contaminante ambiental y sus
efectos sobre la salud humana”, cuenta con cinco epígrafes, los cuales hacen un análisis doctrinal del ruido como contaminante ambiental . El segundo capítulo titulado “Marco legal de lucha contra el ruido dentro del ambiente laboral. Regulación en Cuba”, se encuentra dividido en seis epígrafes en los que se hace un análisis de la tutela jurídica en nuestro país.
The present investigation has like topic: “The contamination for noise inside the labor environment. Considerations about their juridical regulation”. It has as central objective to demonstrate the inadequacies of the legislative and institutional mark for the regulation of the contamination for noise in the labor atmosphere as for their reach and application. The importance of the topic, resides, in the incessant increase of the not controlled focuses of noise, and that it is not taken an effective and appropriate control of its magnitude, localization and grade of affectation about the worker's health and it is reflected its relevance, given its conditioning function before the appearance or worsening of certain affections for the health of the exposed workers; being demonstrated that regulated is not fulfilled effectiveness and there were reached as results a theoretical and systematic analysis of the topic being able to identify the deficiencies of the legislative and institutional regulation as precedent for future modifications as well as the development of the bibliography for later works. It was structured in two chapters. The first titled “Generalities about the noise like environmental pollutant and their effects for the human health”, it has five epigraphs, which make a doctrinal analysis of the noise like environmental pollutant and the second chapter titled “Legal approach of fight against the noise inside the labor atmosphere in Cuba”. It is t divided in six epigraphs in those ones makes an analysis of it guides its juridical treatment l in our country.
