Actualmente uno de los problemas que más hace peligrar la vida en la tierra es el
Cambio Climático, fenómeno que ha provocado disímiles consecuencias negativas
para el futuro del planeta. En el estudio de esta fenomenología hay que considerar
cuestiones pertenecientes a los más diversos campos de la ciencia y de la sociedad, la que constituye la principal fuente generadora de factores influyentes en el mismo, estableciéndose así una relación de causalidad entre la sociedad y el medio ambiente, y por tanto el cambio climático, el cual es el eje fundamental de la
investigación titulada “Mecanismos Jurídicos para afrontar el Cambio Climático.
Consideraciones acerca de su regulación” El objetivo general de la misma es analizar los mecanismos jurídicos para minimizar el cambio climático en el plano nacional e internacional; debido a la importancia que reviste la protección al medio ambiente y que el tratamiento del cambio climático, tanto desde su aspecto legislativo como práctico, es novedoso en Cuba y gran parte
del mundo. La presente investigación cuenta con dos capítulos; un primer capítulo que aborda el marco jurídico y doctrinal del cambio climático, específicamente los mecanismos para afrontarlo, y un segundo capítulo en el cual se realiza un análisis de la situación legislativa existente en Cuba y la aplicación de esta y su concreta implementación, además de determinarse los aciertos y desaciertos de dicha regulación.
At the moment one of the problems that more it makes is in danger the life in the earth it is the Climatic Change, phenomenon that has caused dissimilar negative consequences for the future of the planet. In the study of this phenomenology it is necessary to consider questions belonging to the most diverse fields in the science and of the society, the one that constitutes the main generating source of influential factors in the same one, settling down this way a relationship of causation between the society and the environment, and therefore the climatic change, which is the fundamental axis of the work Juridical Mechanism to confront the Climatic Change. I study of Compared Right". Tracing you as scientific problem the following one: Which are the juridical mechanisms that have been implemented at national and international level to contribute to mitigate and to eliminate the climatic change?, and as general objective: To analyze the juridical mechanisms to minimize the climatic change in the national and international plane; due to the importance that you had the protection to the environment and that the treatment of the climatic change, so much from their aspect legislative as I practice it is novel in Cuba and great part of the world. The present investigation has two chapters; a first chapter that approaches the juridical and doctrinal mark of the climatic change, specifically the mechanisms to confront it, and a second chapter in which is carried out an analysis of the situation existent legislative in Cuba and the application of this and their concrete implementation, besides being determined the successes and mistakes of this regulation.
