dc.description.abstractEl diseño es una actividad creadora que radica en determinar las cualidades formales de los objetos producidos industrialmente. Comprendiendo no solo las calidades exteriores, sino sobre todo las relaciones estructurales y funcionales que hacen del objeto una unidad coherente. El bien jurídicamente protegido por la Propiedad Industrial en materia de Diseño Industrial es, ante todo, el valor añadido por el diseño al producto desde el punto de vista comercial. Por tanto, el Diseño Industrial se concibe como un tipo de innovación formal referido a las características de apariencia del producto en sí, o de su ornamentación. En pos de una armonización de lo que establecen los tratados y acuerdos internacionales en materia de protección jurídica al Diseño Industrial, con la normativa interna de los países signatarios de los mismos, es que se estructura este Trabajo de Diploma. Enfatizando el punto de vista africano, donde el Diseño Industrial se ve muchas veces permeado por las formas de hacer tradicionales de los pueblos. Para llevar a cabo este propósito se introduce el tema, partiendo de la concepción doctrinal de la figura del Diseño Industrial, pasando por su regulación jurídica internacional y analizando la situación africana desde el punto de vista económico, jurídico y social, que la hacen una región con particularidades muy marcadas. En consecuencia, se llega a conclusiones y se brindan recomendaciones, a tono con la bibliografía más actualizada en materia de protección jurídica internacional del Diseño Industrial.en_US
dc.description.abstractDesigning is a creative activity to determine the formal qualities of produced objects. Not only understanding the external qualities, but above all the structural and functional relationships that make an object a coherent unit. The Industrial Property legally protected in Industrial Design is first and foremost, the value added by designing the product from the commercial point of view. Therefore, the Industrial Design is conceived as a kind of formal innovation that refers to appearance of the product itself or its ornamentation. Towards harmonization of what is established in international treaties and agreements on legal protection of Industrial Design, with the internal regulations of the signatory countries of the same, is how this Work is structured. Emphasizing the African perspective, where the Industrial Design is often permeated by the ways of traditional peoples. To accomplish this purpose we introduce the topic, based on the doctrinal conception of the figure of Industrial Design, through its international legal regulation and analyzing the African situation from the economic, legal and social standpoint, that make a region with very marked peculiarities. Accordingly, we reached conclusions and provide recommendations in conjunction with the most current literature/bibliography on international legal protection of industrial design.en_US
