dc.description.abstractEl presente trabajo se titula: La adopción en Cuba: Luces y sombras de su regulación y aplicación práctica. El mismo está dedicado a un tema novedoso y polémico como es el caso de la materialización de los preceptos destinados a esta institución en el Código de Familia cubano, partiendo desde la base doctrinal que permite valorar el tratamiento que recibe la adopción de menores sin amparo filial en nuestro país, así como la aplicación práctica del mismo. De esta manera hemos podido determinar una serie de elementos que propician el hecho de que en nuestro país sea poco frecuente realizar un proceso de adopción e incluso hablar sobre ello. Para cumplir con nuestros objetivos, estructuramos nuestro trabajo en dos capítulos, el primero de ellos dedicado a fundamentar doctrinal y legalmente la institución jurídica objeto de estudio, para en un segundo capítulo valorar dicha institución en nuestro país a partir del tratamiento jurídico que recibe la misma. Como principales resultados de la investigación realizada se presentan la existencia a lo largo de la historia de esta institución, regulándose dos tipos de adopción a nivel global, la pertinencia del principio de interés superior del niño aplicado a estos casos y la enumeración de los factores que inciden en la dilatación del proceso de adopción en Cuba.en_US
dc.description.abstractThe present research is entitled Adoption in Cuba: lights and shadows of its regulation and practical application. It is concerned with a novel and controversial issue as is the case of the realization of the principles intended for this institution in the Cuban Family Code. It starts from the doctrinal bases that allow to assess the treatment received by the adoption of minors without familial protection in our country, as well as the practical application of it. We have been able to determine a series of elements that lead to the fact that in our country it is rare to carry out an adoption process and even to talk about it. To attain our objectives, we structure our work into two chapters, the first of which is devoted to the doctrinal and legal foundation of the institution under study. In the second one we assess this institution, based upon the legal treatment it receives in our country. The main results of the research carried out are (1) an analysis of the existence throughout history of this institution, which shows the regulation of two types of adoption worldwide; (2) the relevance of the principle of best interest for the child applied to these cases and (3) the enumeration of the factors that influence on the dilation of the adoption process in Cubaen_US
