El maltrato animal. Una norma pendiente del Derecho Penal cubano

Abstract

La presente investigación es un anhelo de muchos, en la cual se intenta concretar y solucionar una problemática que afecta a la integridad de una colectividad pacífica. Este trabajo se une a las peticiones de la población, las cuales van in crescendo, a favor de que se elimine el maltrato animal como elemento común en la mayoría de los contextos que engloban el comportamiento social de nuestro país. Su objetivo principal radica en exponer las características del maltrato animal para identificarlo como forma de violencia con repercusión en el plano micro y macro social y, plantear desde la perspectiva del Derecho comparado, las bases legales para su reglamentación penal como vía para hacer efectivo el propósito de eliminar de las relaciones sociales conductas violentas que pueden tener repercusión en el plano societal. La realización de esta tesis intenta además, captar la atención de los organismos gubernamentales con la pretensión de aunar esfuerzos y voluntades en el sentido de proponer, por la vía legislativa, normas eficaces para la protección de las especies animales pero teniendo a estas como bien jurídico específico y crear conciencia para incentivar en la población la adopción de métodos más respetuosos basados en la consideración de que los animales no son objetos inmateriales sino seres vivos capaces de percibir el dolor que el hombre en sus momentos de bestialidad puede propiciarles.

The present investigation is a longing of many, where it is tried to concretize and solve a problematic that affects the integrity of a pacific collectivity. This work adds to the petitions of the population, which go gradually in crescendo, in favor to eliminate the animal mistreatment, like common element in most of the contexts that encompass the social behavior of our country. Its main purpose consists in exposing the characteristics of the animal mistreatment, to identify it like way of violence, with repercussion in micro and macro social environment. Also to set, from the perspective of the compared Right, the legal bases for his penal regimentation like a way to make effective the purpose of eliminating violent conducts from social relationships, that can have repercussion in the social environment. The realization of this thesis tries besides, catching the government agencies attention, with the aspiration of joining efforts and wills in the sense of proposing, for the legislative way, efficacious norms for the protection of animal species, but having these like juridical specific good, and creating conscience for to motivate in the population the adoption of more respectful methods based in the consideration that animals are not immaterial objects, but capable living beings to perceive the pain that the man in their moments of bestiality can propitiate them.
