Resumen
La presente investigación trata el tema de los derechos inherentes a la personalidad en la esfera moral de los menores de edad: el honor, la intimidad y la imagen. Estos son fundamentales para el hombre y se manifiestan en el orden público y privado. Los derechos de la personalidad le permiten a la persona reconocer determinados valores morales valiosos y esenciales para todos, desde el orden jurídico constituyen un apreciable instrumento para que el ser humano pueda ser reconocido como personalidad plena. Su regulación legislativa y la protección jurídica son sumamente importantes, pues permiten alcanzar el desarrollo completo de la personalidad. Se parte de un análisis teórico jurídico de estos derechos, centrándose la atención en la dificultad que poseen los menores de edad para ejercerlos por sí solos, ante una intromisión ilegítima, debido a su capacidad. También se realiza un análisis de la protección que ofrece el ordenamiento jurídico cubano. El informe de tesis se estructura en dos Capítulos: el primero constituye el soporte teórico de la investigación. En el segundo se examinan las normas que los regulan y la protección que brinda el orden legal cubano a estos derechos.
The present investigation deals with the theme of the rights inherent to the personality in the moral sphere of age minors: the honor, the intimacy and the image. These are fundamental for man and it is manifested in the public and private order. The rights of the personality allows the person to recognize determined moral values valuable and essential for everybody, from the judicial order they are a wonderful instrument so that the human being can be recognized as a complete personality. It’s legislative regulation and the judicial protection are very important, because it permits the full development of the personality. This thesis is derived from a judicial theoretical analysis of these rights, centering the attention in minors’ difficulty to exercise them by themselves in the face of illegitimate interference, due to their capacity. An analysis of the protection that the cuban judicial order is also provided in the thesis. This thesis report structured in two chapters: the first is about the theoretical support of the investigation. In the second the norms that regulate them, and the protection that the legal cuban order provides to these rights are analyzed.
