Resumen
La presente investigación se titula ―El trabajador por cuenta propia en Cuba: ¿empresario mercantil individual?‖, tiene como objetivo principal demostrar que un grupo de cuentapropistas reúnen las características de los empresarios mercantiles individuales.
La actividad por cuenta propia en Cuba, surge como alternativa al desempleo, y complemento a los servicios ofrecidos por el sector estatal de la economía. En la actualidad existe un auge de la misma, lo que ha traído consigo que se desarrollen algunas actividades más que otras y que lleguen a ser tan complejas que su actividad pueda ser comparada con la de un empresario mercantil individual. La no existencia de empresarios individuales en Cuba es de derecho, mientras que de hecho, se observa esta figura en el despliegue de la actividad económica del cuentapropista. Esta divergencia entre el derecho y el hecho, viene dado por la posición política del Estado cubano contraria a la aceptación del sector individual privado en la economía, por ser opuesta al sistema socialista.
En el trabajo se hace un análisis doctrinal de la figura del empresario mercantil individual y de los requisitos legales para ser considerado como tal, con el fin de encontrar los elementos comunes entre éste y los cuentapropistas, basándonos en la legislación vigente y en las características reales y actuales de su actividad en la localidad; donde existen algunos ejemplos de verdaderas empresas mercantiles, que juegan un papel fundamental en el mercado debido a la importancia de los bienes y servicios que ofertan.
This research is titled ―The self-employment: individual business?‖, the principal aims to show that there is a group of self-employment that have characteristics of the individual business. The self-employment in Cuba, is an alternative to unemployment, as well as a complement to the services offered by the state sector of the economy. Currently there is a boom in the same, what has brought you to develop some activities more than others and that some become so complex that its activity can be compared with that of a single commercial entrepreneur. The absence of individual entrepreneurs in Cuba is right, whereas in fact, see this figure in the deployment of self-employed economic activity. This divergence between law and fact, is given by the Cuban state policy position contrary to the acceptance of the private individual sector in our economy, being opposite to the socialist system that characterizes us. In the paper a doctrinal analysis of the entrepreneur individual commercial and legal requirements to be considered as such, in order to find common elements between this and the self-employed, based on current legislation and the actual characteristics current and its activity in the territory of Santa Clara, where there are some real examples of commercial enterprises, which play a key role in the market because of the importance of the goods and services they offer.
