dc.description.abstractEl presente trabajo titulado “Fundamentos sociojurídicos del proyecto socialista cubano en el periodo de 1976 a 1990” estuvo motivado por la carencia de investigaciones científicas sobre el tema. Este estudio se centra en el periodo de 1976 a 1990 cuyo rasgo esencial fue la institucionalización del Estado socialista, aunque se mantuvo como rasgo, a lo largo de todo el proceso de construcción del socialismo, la lucha por el mantenimiento de la independencia y la soberanía nacional, lo cual, aún en la actualidad, persiste. Tanto la institucionalización del Estado como el ordenamiento jurídico reflejaron las aspiraciones más genuinas del pueblo cubano, sin embargo, adolecieron de errores y tendencias negativas que fueron creando numerosos problemas y dificultades en la construcción socialista. Ello conllevó a que en el año 1986 se iniciara el proceso de rectificación de errores y tendencias negativas que pretendía erradicar el formalismo de las relaciones políticas, económicas y sociales en general, generado en parte, por una copia acrítica de un modelo ajeno a la historia, las tradiciones y las peculiaridades de la sociedad y de la revolución cubana. El proceso de rectificación se interrumpe abruptamente por la caída de la URSS y el resto de los países socialistas de Europa del Este, dando surgimiento al llamado periodo especial donde lo esencial fue la supervivencia de la revolución y de sus conquistas más importantes. En esta investigación partimos de la siguiente interrogante: ¿Sobre qué fundamentos socio jurídicos se desarrolló el proyecto socialista cubano durante el periodo de 1976 a 1990? y de la siguiente Hipótesis: Los fundamentos socio jurídicos sobre los que se desarrolló el proyecto socialista cubano durante el periodo de 1976 a 1990 fueron: la institucionalización del Estado socialista y la rectificación de errores y tendencias negativas en la construcción del socialismo. La novedad de la investigación radica en determinar dichos fundamentos y constatar su manifestación concreta en las Leyes y disposiciones normativas dictadas durante la etapa, a través del análisis de su contenido y sus por cuantoen_US
dc.description.abstractThe present pager entitled “Socio judgment fundament of the Cuban Socialist project in the period 1976 to 1990” was motivated by the lack of scientific research about this theme. This study is centered in the period from 1976 to 1990 whose main feature was the socialist state institutionalization. Although it was maintained as a feature along the whole process of socialism, the fight for a maintaining the independence and national sovereign, which even at present, persist the institutionalization of the state as well as the judgment order reflect the most genuine aspirations of the Cuban people. However, they had mistakes and negative tendencies that provoked various problems and difficulties in the socialist constitution. It contributed to the beginning of the process of rectifying mistakes and negative mistakes in 1986 that pretended to eradicate formalism in the political, economical and social relationships in general. It had generated a critical copy of a foreign model to the history, traditions and peculiarities of society and Cuban revolution. The process of rectifying mistakes was abruptly interrupted by the falling of the Soviet Union and the rest of the eastern European socialist country, followings the so-called special period where the essential feature was survival of the revolution and it most important congress. This research is started out of the following research questions: What socio judgment of the Cuban socialist project during the period from 1976 to 1990? And the following hypothesis: the socio judgment fundaments about what the Cuban socialist project was developed during the period from 1976 to 1990 are given in the institutionalization of the socialist state and the rectifying of mistakes and negative tendencies in socialist construction. The novelty of the research is related to the determination of the fundaments and supports its concrete manifestation and the laws and normative dispositions made during this time through the analysis of its content and their SINCE.en_US
